1. Acceptance of Terms
By accessing and using SexDiary, you accept these Terms and Conditions in full. If you do not agree with any part of these terms, you must refrain from using the App.
2. Description of Service
SexDiary is a private journal app that allows users to log intimate activities, view statistics, and create/restore backups of their data.
3. Eligibility
To use SexDiary, you must be at least 18 years old or the age of majority in your jurisdiction. By registering, you represent and warrant that you meet these requirements.
4. Account Registration
a. Account Creation:
- You must provide accurate and complete information during registration.
- You are responsible for maintaining the confidentiality of your password and all activities that occur under your account.
b. Account Security:
- Notify us immediately of any unauthorized use of your account.
- SexDiary will not be liable for any losses resulting from your failure to secure your login information.
5. Use of the Appp
a. User Conduct:
- You will not use the App for illegal, harmful, or rights-infringing activities.
- You will not attempt to gain unauthorized access to other users or SexDiary systems.
b. User Content:
- You are solely responsible for the content you enter into your private journal.
- SexDiary does not monitor, review, or edit your journal content but reserves the right to remove content that violates these terms.
6. Intellectual Property
a. Copyrights:
- The App and its original content are owned by SexDiary and protected by intellectual property laws.
- You may not reproduce, distribute, modify, or create derivative works without our express permission.
b. Usage License:
SexDiary grants you a limited, non-exclusive, non-transferable license to use the App in accordance with these Terms.
7. Privacy
Your use of the App is also governed by our Privacy Policy. By using SexDiary, you agree to the practices described in the policy.
8. Payments and Subscriptions
a. Business Model:
- SexDiary may offer free and paid features. Subscriptions and payments are managed through Apple’s App Store, in accordance with their terms and conditions.
b. Cancellations:
- You can cancel your subscription at any time via your account settings in the App Store. Refunds will not be issued for payments already made.
9. Termination
We may suspend or terminate your access to the App at any time, without prior notice, for violating these Terms or for any other reason. Upon termination, all licenses and rights granted will cease.
10. Disclaimer of Warranties
SexDiary is provided "as is" and "as available." We do not guarantee that the App will be error-free, uninterrupted, or meet your expectations. We disclaim all warranties, express or implied.
11. Limitation of Liability
Under no circumstances shall SexDiary be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the App, even if we have been advised of the possibility of such damages.
12. Indemnification
You agree to indemnify, defend, and hold harmless SexDiary and its affiliates from any claims, demands, damages, liabilities, and expenses, including reasonable attorneys' fees, arising out of your use of the App or your violation of these Terms.
13. Governing Law and Jurisdiction
